This increase was on top of the across the board increases for all ATU employees and was intended to bring our TSO's more in line with the market value for the position.<br \/>\n<br \/>\nMetrolinx, following our 2018 round of bargaining, removed the article in question from the collective agreement resulting in a loss of the $.25 increase.<br \/>\n<br \/>\nIn February 2019 ATU 1587 filed a policy grievance arguing that the article should have remained in place for all future collective agreements.  Subsequently, this matter moved to arbitration resulting in hearing dates in late 2020 and early 2021.<br \/>\n<br \/>\nWe are pleased to announce that an arbitrated decision in our favour was reached on May 6, 2021.  <br \/>\n<br \/>\nArticle 39.4(6) will be included in the 2018-2022 collective agreement and our TSO's will continue to receive their increase.<br \/>\n<br \/>\nAlthough this is a win for 1587, this grievance took 2 years, 3 months to settle and it reminds us that we must remain diligent and always continue the fight...<br \/>\n","posted":"May 7th, 2021"},{"wins_id":"5","title":"Oncidium","state":"An Update:  April, 2021","body":"In 2015 Metrolinx began to use Wellpoint as a third-party service provider tasked with assisting Metrolinx administer and adjudicate short-term medical leaves and\/or accommodations.<br \/>\r\n<br \/>\r\nATU1587 filed a policy grievance against this practice in August 2016.  This policy grievance was later withdrawn, and multiple individual grievances were filed in its place.<br \/>\r\n<br \/>\r\nIn November 2018 Oncidium replaced Wellpoint as the new provider of these services.<br \/>\r\n<br \/>\r\nAlthough it has taken some time to have this matter heard in arbitration, the process has finally begun.  At present we are in the midst of arbitrating this case with legal arguments set to conclude summer, 2021. OnCorr","state":"Grievance Filed: March 2021","body":"Recently Metrolinx announced that, as part of its GO Expansion initiative, the OnCorr program (short for On-Corridor Works) will take over the Design, Build, Operation and Maintenance of several key existing and new GO facilities, including the Willowbrook Rail Maintenance Facility.<br \/>\r\n<br \/>\r\nThe OnCorr program is currently in the tendering phase and will eventually be awarded to a consortium of companies; this group of companies is referred to as \"Project Co.\"<br \/>\r\n<br \/>\r\nIn March 2021 ATU1587 filed a policy grievance against Metrolinx arguing that the work to be assumed by Project Co. is 1587 bargaining unit work, and that OnCorr contravenes, among other things, Letter of Agreement #3 and Article 27 of the Collective Agreement.<br \/>\r\n<br \/>\r\nOnCorr represents a significant risk to our members, and we are committed to continuing our fight against all forms of contracting out, including Public \/ Private Partnerships.<br \/>\r\n<br \/>\r\nWe will keep you up to date as the grievance process advances or as more information becomes available.","posted":"April 16th, 2021"},{"wins_id":"3","title":"Bill 124: CHARTER CHALLENGE","state":"Legal Proceeding Commenced...","body":"ATU1587 has joined 40 other unions in a Charter challenge against Bill 124, the so called \"Protecting a Sustainable Public Sector for Future Generations Act\".<br \/>\r\n<br \/>\r\nThis Bill, which received Royal Assent in November 2019, will essentially limit annual increases to a total of 1%, including wages and cost of benefits.<br \/>\r\n<br \/>\r\nThe coalition of approx. 270,000 Ontario workers, led by the Ontario Federation of Labour, filed the application in 2020 with affidavits filed in February 2021, and is arguing that the Bill breaches the right to collective bargaining as protected in the Charter of Rights and Freedoms.<br \/>\r\n<br \/>\r\nCourt dates are expected late in 2021 and we will update the membership throughout the process or as new information arises.","posted":"April 16th, 2021"},{"wins_id":"2","title":"Settled...  Non-Bargaining Staff doing Bargaining Unit Work ","state":"Project Coordinator \/ Project Manager,  OFPT","body":"In 2018 ATU 1587 filed a policy grievance against Metrolinx arguing that Non-Union Project Managers were doing the work of Project Coordinators.  This grievance arose from the restructuring of the Capital Infrastructure Projects group where, according to Metrolinx, Project Managers became primarily responsible for the completion of capital projects.<br \/>\r\n<br \/>\r\nIn November 2020, following several months of arbitration where both ATU 1587 and Metrolinx presented several witnesses, we are pleased to announce that we have reached a settlement with Metrolinx.<br \/>\r\n<br \/>\r\nThis settlement further protects the rights of Project Coordinators by, among other things, clarifying the roles of both PC's and PM's.<br \/>\r\n<br \/>\r\nAs of April 2021 we are continuing our discussions with Metrolinx and hope to be able to announce further details of the settlement shortly.<br \/>\r\n<br \/>\r\nATU 1587 represents approximately 130 Project Coordinators whose primary duties involve managing capital projects.<br \/>\r\n<br \/>\r\nStay tuned...<br \/>\r\n","posted":"April 16th, 2021"},{"wins_id":"1","title":"A WIN for 1587!
